Terms & Conditions

1. Introduction

MarsFitt App ("the App"), is a platform designed to connect customers seeking personal trainers ("Clients") with professional personal trainers ("Trainers" or “Coaches”). These Terms and Conditions ("Terms") govern your use of the MarsFit app and the services provided through it. By using the MarsFit app, you agree to these Terms. If you do not agree, please do not use the App.

2. Effectiveness

These Terms take effect once you sign up for the App and agree to them through the prescribed method in the App, by clicking the "I agree" button. By doing so, you are considered to have thoroughly read and comprehended all of these Terms and agreed to abide by them. 

3. Eligibility

Clients: You must be at least 18 years old to use the App.

Trainers: You must be a personal trainer and meet all legal requirements to offer personal training services in your jurisdiction.

4. Registration and Accounts

Account Creation: Both Clients and Trainers must create an account to use the App's services. You agree to provide accurate and complete information during registration.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Services Provided

For Clients: The App allows you to search for, connect with, and hire Trainers based on your preferences.

For Trainers: The App provides a platform to offer your services, manage client bookings, and receive payments.

6. Fees and Payments

Subscription Fees: Trainers will be required to pay a subscription fee to use certain features of the App. These fees will be billed in advance on a recurring basis.

Payment Processing: Payments for training sessions are processed through the App Store and Play Store.

Late Payments: The App reserves the right to charge additional fees for late payments.

7. Cancellations and Refunds

The App is not responsible for payments between Trainers and Clients; any cancellations, refunds, or disputes regarding payments are solely the responsibility of the involved parties.

The App absolves itself from any responsibility or liability arising from potential issues that may occur between the trainer and the client, such as injuries or similar incidents. Users are advised that engaging in inappropriate or misuse of the App may lead to sanctions, including but not limited to, suspension or permanent exclusion from accessing or using the App.

8. Cancellations and Missed Sessions

MarsFit holds no responsibility for any cancellations or missed sessions. It is the responsibility of the user and the coach to manage and communicate any changes to their scheduled sessions. MarsFit shall not be liable for any losses, damages, or inconveniences resulting from cancellations, no-shows, or rescheduled sessions. Users and coaches are expected to agree upon their own terms regarding cancellations or rescheduling.

9. Use of the App

The App absolves itself from any responsibility or liability arising from potential issues that may occur between the trainer and the client, such as injuries or similar incidents. Users are advised that engaging in inappropriate or misuse of the App may lead to sanctions, including but not limited to, suspension or permanent exclusion from accessing or using the App.

Permitted Use: You agree to use the App only for lawful purposes and in accordance with these Terms.

Prohibited Use:

You agree not to use the App to:

Violate any local, state, national, or international law.

Harass, abuse, or harm another person.

Impersonate any person or entity or misrepresent your affiliation with a person or entity.

Engage in any activity that could damage, disable, overburden, or impair the App.

10. Intellectual Property

Ownership: The App and its entire contents, features, and functionality are owned by Deployinc and are protected by intellectual property laws.

License: Deployinc grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for its intended purposes.

11. Liability and Disclaimers

No Guarantees: The App does not guarantee any specific outcomes from using the services. Results may vary based on individual circumstances.

Assumption of Risk: Clients assume all risks associated with participating in training sessions, including physical injury.

Limitation of Liability: Deployinc is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

12. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found on https://marsfit.app/privacy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on the App and updating the date at the top of the document. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising from these Terms will be resolved in the courts of [Jurisdiction].
